This session will survey recent wrongful imprisonment lawsuits to identify how wrongful incarceration claims emerge. Presenters will use case studies to identify in the process where and why things go awry, at what point pools find themselves paying out claims, and the trigger date used to determine payouts. The presenters will focus on the factual and legal factors relating to liability and exposure that most impact a successful defense of wrongful imprisonment claims, and the core coverage issues that pools should examine in connection with these lawsuits. Through this discussion, pools will have an understanding of how to better handle wrongful incarceration claims and lawsuits.
